AND NOW, this 20th day of October, 2008, upon consideration of the Defendant’s (Joey boy) Petition for Writ of Habeas Corpus “, which was included in the “Defendant’s Omnibus Pre-Trial Motions”, and after a hearing held thereon on October 10, 2008, it is hereby Ordered and Decreed that the Defendant’s “Petition for Writ of Habeas Corpus” is DENIED.

1. A Rule is issued upon the Respondents, Commonwealth of Pennsylvania and Joseph J Krex, to show cause why the moving party, Brian J Collins, Esq, is not entitled to the relief requested.
2. The Respondents shall file an answer to the Petition within 20 days of this date.
3. If an answer is filed, hearing/argument shall be scheduled or other appropriate action shall be taken by the Court.
4. In the event no answer is filed, the Court may grant the relief requested.
5. Notice of entry of the Order shall be provided to all parties by the moving party.
